The company I'm currently looking at uses a significant number of H-2B workers. The company has all the H-2B workers it needs for the upcoming season, and I have become comfortable with the strategy to obtain these visas as well as my ability to diversify the workforce going forward. However, the question I'm looking at now is whether and how I will be able to transfer these existing H-2B workers over to my acquiring entity in an asset purchase. I need these workers at least for the upcoming season and will not have time to rebuild a significant portion of the workforce if my new entity cannot re-hire these H-2B workers. Does anyone have any experience with this? Would love to talk to anyone with experience managing or acquiring a business with H-2B workers.
