The federal appeals court that issued the stay against the implementation of the OSHA Emergency Temporary Standard (ETS) has re-affirmed its view that OSHA exceeded its authority in issuing the ETS, increasing the odds that the ETS will never be enforced. However, other legal maneuvering on this issue is likely.
